People’s Republic of China Citizen Indicted for Allegedly Stalking, Threatening Individual Promoting Democracy in China
A Berklee College of Music student, who is a citizen of the People’s Republic of China (PRC), has been indicted by a federal grand jury in Boston in connection with allegedly stalking and threatening an individual who posted fliers in support of democracy in China.

Xiaolei Wu, 25, was indicted on one count of cyberstalking and one count of interstate transmissions of threatening communication. Wu was previously arrested and charged by criminal complaint with one count of stalking on Dec. 13, 2022. Wu has lived in Boston while attending the Berklee College of Music.

According to the charging documents, on Oct. 22, 2022, an individual posted a flier on or near the Berklee College of Music campus in Boston which said, “Stand with Chinese People,” as well as, “We Want Freedom,” and “We Want Democracy.” It is alleged that, beginning on or about Oct. 22, 2022, and continuing until Oct. 24, 2022, Wu made a series of communications via WeChat, email, and Instagram directed towards the victim who posted the flier. Among other things, Wu allegedly said, “Post more, I will chop your bastard hands off.” He also allegedly told the victim that he had informed the public security agency in China about the victim’s actions and that the public security agency in China would “greet” the victim’s family. It is further alleged that Wu solicited others to find out where the victim was living and publicly posted the victim’s email address in the hopes that others would abuse the victim online.

The charge of cyberstalking provides for a sentence up to five years in prison, three years of supervised release and a fine of up to $250,000. The charge of interstate transmissions of threatening communication provides for a sentence up to five years in prison, three years of supervised release and a fine of up to $250,000.

Assistant Attorney General Matthew G. Olsen of the Justice Department’s National Security Division, U.S. Attorney Rachael S. Rollins for the District of Massachusetts, Assistant Director Alan E. Kohler Jr. of the FBI’s Counterintelligence Division, and Special Agent in Charge Joseph R. Bonavolonta of the FBI Boston Division made the announcement.

Assistant U.S. Attorney Timothy H. Kistner for the District of Massachusetts is prosecuting the case, with valuable assistance provided by Trial Attorney Menno Goedman of the National Security Division’s Counterintelligence and Export Control Section.

A complaint is merely an allegation. All defendants are presumed innocent until proven guilty beyond a reasonable doubt in a court of law.

Texas Biologist Sentenced for Wildlife Trafficking
A federal judge in Amarillo yesterday sentenced Dr. Richard Kazmaier, 55, to six months in prison, three years of post-release supervision, and a $5,000 fine. Kazmaier pleaded guilty on Aug. 19, 2022, to a Lacey Act felony for importing protected wildlife into the United States without declaring it or obtaining the required permits.

According to court documents, Kazmaier was an associate professor of biology at West Texas A&M University before resigning in October 2022. A federal grand jury issued an indictment in January 2022 charging Kazmaier with smuggling goods into the United States and two violations of the Endangered Species Act. Kazmaier pleaded guilty to a superseding information charging the Lacey Act, the nation’s oldest wildlife trafficking statute. The court dismissed the indictment at the government’s request.

The Lacey Act and federal regulations require importers to declare wildlife to customs and U.S. Fish and Wildlife Service when it enters the country. Between March 2013 and February 2020, Kazmaier admitted he imported wildlife items from Bulgaria, Canada, China, Czech Republic, Indonesia, Latvia, Norway, Russia, South Africa, Spain, the United Kingdom, and Uruguay into Texas without declaring them. Kazmaier admitted he purchased and imported approximately 358 wildlife items with a total market value of $14,423 from eBay and other online sales websites. He did not import any live animals and instead purchased mostly skulls, skeletons, and taxidermy mounts.

The Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) regulates trade in endangered or threatened species through permit requirements. The United States and 183 other countries are signatories to the CITES treaty. Kazmaier acknowledged importing 14 protected species without obtaining permits, including the Eurasian otter, lynx, caracal, vervet monkey, greater naked-tailed armadillo, and king bird-of-paradise.

The U.S. Fish and Wildlife Service’s Office of Law Enforcement in Redmond, Washington, conducted the investigation as part of Operation Global Reach. The operation focused on the trafficking of wildlife from Indonesia to the United States.

The government is represented by Assistant U.S. Attorney Anna Marie Bell for the Northern District of Texas and Senior Trial Attorney Ryan Connors of the Department of Justice’s Environmental Crimes Section.

Alabama Company Pleads Guilty in Worker Death Case !!!

ABC Polymer Industries LLC pleaded guilty yesterday to a willful violation of an Occupational Safety and Health Administration (OSHA) standard that caused a worker’s death. The charge involves an Aug. 16, 2017, incident at the Helena, Alabama, plant owned by ABC Polymer Industries LLC, in which a worker was pulled into a cluster of unguarded moving rollers and killed. U.S. District Judge Annemarie Carney Axon for the Northern District of Alabama accepted the plea.

According to court documents, ABC Polymer operated multiple plastic extrusion lines at its facility, which molded raw materials into flat rectangular plastic sheets. The machinery pulled the sheets through a series of rollers arranged in clusters before cutting them into plastic threads or tapes, which were sold for use in various products. According to court documents filed in connection with the case, the machine at issue in the worker’s death was equipped with a “cage” or barrier guard that could be pulled down over one of the exposed sides of the rollers. OSHA standards require moving machinery such as this to be guarded while the machine is energized.

However, ABC Polymer was aware that its employees routinely raised the guard on its machines to cut tangled plastic off the rollers, thereby operating the machines without the required guarding. ABC Polymer also trained its employees to cut tangled plastic off the rollers while the rollers were in operation. ABC Polymer admitted that it knew or should have known that these practices exposed employees to a risk of injuries and death in violation of federal law.

“This victim’s tragic death was entirely preventable,” said Assistant Attorney General Todd Kim of the Justice Department’s Environment and Natural Resources Division. “Employers who willfully violate OSHA standards are gambling with their employees’ health and lives. We will continue to hold accountable those who fail to follow these critical safety rules.”

“This tragic loss of life could have been avoided by following federal safety standards,” said U.S. Attorney Prim F. Escalona for the Northern District of Alabama. “We are grateful for the work of our OSHA partners in holding employers accountable for the safety of their employees. My office will use the tools available to us to protect Alabama workers and prosecute employers who willfully violate federal safety laws.”

Federal law makes it a class B misdemeanor to willfully fail to follow an OSHA safety standard, where the failure causes the death of an employee. The class B misdemeanor is the only federal criminal charge covering such workplace safety violations. The count of conviction carries a maximum sentence of a $500,000 fine, or twice the financial gain to the defendant or twice the financial loss to another, whichever is greater, and restitution to the victim. Judge Axon scheduled sentencing for Jan. 24 where she will determine the sentence after considering the relevant statutory factors.

This case was investigated by the Occupational Safety and Health Administration of the U.S. Department of Labor.

Si le contrat de travail est conclu pour une durée indéterminée, à temps plein, la rédaction d’un écrit, même si elle est vivement conseillée, n’est pas obligatoire, sauf dispositions contraires prévues par la convention collective applicable.
Qui peut conclure un contrat de travail ?
L’employeur peut être une personne physique (entrepreneur individuel…) ou une personne morale (association, SARL…). Dans ce cas, le contrat est conclu par la personne munie du pouvoir d’engager la société : gérant, directeur dont les fonctions comportent le recrutement de salariés, etc. Sur ce point, on signalera que, selon la jurisprudence de la Cour de cassation (arrêt du 15 déc. 2010), la « délégation du pouvoir de conclure un contrat de travail peut être tacite […] ; elle peut découler des fonctions du salarié signataire du contrat pour le compte de l’employeur ».

Côté salarié, toute personne peut conclure un contrat de travail avec, cependant, quelques restrictions concernant le majeur sous tutelle (le contrat doit alors être conclu avec son représentant, le tuteur) et les jeunes de moins de 18 ans.

Ceux-ci ne peuvent en effet conclure de contrat de travail sans l’autorisation de leur représentant légal (père, mère, tuteur), sauf s’ils sont émancipés, c’est-à-dire considérés comme majeurs après décision de justice (voir précisions ci-après). En outre, selon leur âge certaines règles doivent être observées :

il est interdit d’employer des jeunes de moins de 16 ans, sauf cas particuliers :
pour les activités du spectacle et de mannequins sur autorisation du préfet ;
dans le cadre de l’apprentissage à partir de 15 ans ;
ou pendant une partie des vacances scolaires à partir de 14 ans ;
dans tous les cas, l’employeur est soumis à des contraintes spécifiques, en particulier en matière de sécurité et de durée du travail dès lors que le jeune a moins de 18 ans.
Autorisation parentale pour les mineurs
L’autorisation écrite de travail pour les mineurs de moins de 18 ans n’étant pas considérée comme un acte courant de l’exercice de l’autorité parentale, l’accord écrit des deux parents est expressément requis. Lorsque les parents ne parviennent pas à s’entendre, celui d’entre eux qui souhaite consentir au travail de son enfant mineur non émancipé doit obtenir l’autorisation préalable du juge des tutelles. Le contrat doit-il être écrit ?
Seul le contrat à durée indéterminée (CDI) à temps complet peut être non-écrit (sauf dispositions conventionnelles contraires). Le contrat est alors qualifié d’oral, de verbal ou de tacite.

Toutefois, si le contrat reste verbal, l’employeur a l’obligation de remettre au salarié un document écrit reprenant les informations contenues dans la déclaration préalable à l’embauche adressée à l’URSSAF (ou à la Mutualité sociale agricole - MSA). Il doit également, en application de la directive (UE) 2019/1152 du 20 juin 2019 relative à des conditions de travail transparentes et prévisibles dans l’Union européenne, notamment ses articles 4 à 7, informer les travailleurs des éléments essentiels de la relation de travail.

Hormis le CDI à temps complet, tous les autres contrats doivent être écrits. Sont concernés :

le contrat à durée indéterminée à temps partiel ;
le contrat à durée déterminée ;
le contrat de travail à temps partiel ;
le contrat de travail intermittent ;
le contrat de travail temporaire ;
le contrat de professionnalisation ;
le contrat d’apprentissage
les contrats spécifiques prévus pour les personnes en difficulté, notamment le contrat unique d’insertion, dans sa forme contrat d’accompagnement dans l’emploi ou contrat initiative-emploi
les contrats conclus avec les groupements d’employeurs ;
le « contrat de travail en portage salarial » à durée déterminée, ou à durée indéterminée.
Le portage salarial

Le portage salarial désigne l’ensemble organisé constitué par :

D’une part, la relation entre une entreprise dénommée « entreprise de portage salarial » effectuant une prestation au profit d’une entreprise cliente, qui donne lieu à la conclusion d’un contrat commercial de prestation de portage salarial ;
D’autre part, le contrat de travail conclu entre l’entreprise de portage salarial et un salarié désigné comme étant le « salarié porté », lequel est rémunéré par cette entreprise.
Le salarié porté justifie d’une expertise, d’une qualification et d’une autonomie qui lui permet de rechercher lui-même ses clients et de convenir avec eux des conditions d’exécution de sa prestation et de son prix. Il bénéficie d’une rémunération minimale définie par accord de branche étendu. À défaut d’accord de branche étendu, le montant de la rémunération mensuelle minimale est fixé à 75 % de la valeur mensuelle du plafond de la sécurité sociale (plafond fixé à 3 666 euros depuis le 1er janvier 2023 et à 3 428 euros de 2020 à 2022) pour une activité équivalant à un temps plein.

Rédiger le contrat de travail : quelles règles respecter ?
Lorsqu’il est conclu en France, le contrat doit être rédigé en français. Il peut toutefois comporter des termes étrangers, sans correspondance en français, s’ils sont clairement expliqués. Pour plus de précisions sur l’emploi de la langue française dans les relations de travail, on pourra utilement se reporter au document mis en ligne sur ce site.

Le salarié étranger peut demander la traduction de son contrat dans sa langue d’origine.

L’employeur et le salarié sont libres de négocier le contenu du contrat de travail. Deux règles doivent néanmoins être respectées :

s’agissant d’un contrat dont la rédaction est imposée (contrat à durée déterminée, contrat de formation en alternance… - voir ci-dessus), il contient obligatoirement les mentions prévues par le Code du travail ;
toute autre clause peut être insérée (clause de mobilité…) à condition de ne pas être contraire à l’ordre public. Ainsi par exemple, les clauses de célibat, les clauses discriminatoires ou celles prévoyant une rémunération inférieure au SMIC sont interdites et sans effet.
Le contrat de travail peut-il comporter une période d’essai ?
Oui, c’est une possibilité laissée à l’appréciation de l’employeur et du salarié. Prévoir une période d’essai permet à l’employeur comme au salarié de rompre, au cours de la période fixée, le contrat de travail sans formalité ni indemnité, mais en respectant un délai de prévenance.

La période d’essai et la possibilité de son renouvellement dans les limites fixées par la loi, ne se présument pas : elles doivent être mentionnées dans le contrat de travail ou dans la lettre d’engagement ; pour plus de précisions, on peut se reporter à la fiche consacrée à cette question.

Des dispositions particulières s’appliquent au contrat à durée déterminée

Le contrat de travail ou la lettre d’engagement ne peut pas fixer une période d’essai d’une durée supérieure à celle prévue par la loi. De même, un salarié à temps partiel ne peut se voir imposer une période d’essai plus longue que celle d’un salarié à temps plein.

Quelles obligations découlent du contrat de travail ?
Employeur et salarié doivent respecter les obligations nées du contrat de travail et exécuter celui-ci de bonne foi :

l’employeur est tenu de :

fournir un travail dans le cadre de l’horaire établi,
verser le salaire correspondant au travail effectué,
respecter les autres éléments essentiels du contrat (qualification, lieu de travail quand il est précisé dans le contrat…),
faire effectuer le travail dans le respect du Code du travail et de la convention collective applicable à l’entreprise ;
le salarié doit, quant à lui :

observer les horaires de travail,
réaliser le travail demandé conformément aux instructions données,
respecter les engagements mentionnés dans le contrat de travail et, lorsqu’il en existe un, les clauses du règlement intérieur,
ne pas faire de concurrence déloyale à son employeur.
Quelles sont les situations entraînant la suspension du contrat de travail ?
Dans un certain nombre de situations prévues par le Code du travail, le contrat de travail est suspendu, ce qui a pour principal effet de dispenser le salarié d’exécuter sa prestation de travail. De son côté, l’employeur est, en principe, dispensé du versement du salaire pour la période correspondant à la suspension du contrat ; il peut toutefois être tenu, selon les motifs de la suspension, au versement d’une indemnité (ex. : indemnité de congés payés) ou d’une allocation (ex. : activité partielle). Parmi les principaux congés ou absences entraînant la suspension du contrat de travail, on signalera :

les congés de maternité, de paternité et d’accueil de l’enfant ou d’adoption ;
les congés pour événements familiaux ;
le congé de présence parentale, le congé parental d’éducation, le congé de proche aidant, le congé de solidarité familiale ;
les congés payés ;
le congé sabbatique ;
le congé pour création ou reprise d’entreprise ;
les arrêts de travail pour maladie (professionnelle ou non), accidents du travail ou accidents de trajet ;
les congés payés ;
l’activité partielle ;
certains congés de formation.
Au terme de la période de suspension, le salarié doit retrouver son emploi ou un emploi similaire assorti d’une rémunération au moins équivalente. Sauf cas particuliers (ex. : congé de maternité, accidents du travail), la suspension de son contrat de travail ne le protège pas contre une éventuelle mesure de licenciement.

Mobilité volontaire sécurisée
Le contrat de travail d’un salarié qui bénéficie d’une période de mobilité volontaire sécurisée est également suspendu.

Quelles sont les situations susceptibles d’entrainer la suspension du contrat de travail dans le contexte de lutte contre l’épidémie de Covid-19 ?
Sauf contre-indication médicale à la vaccination contre la covid-19 reconnue dans les conditions définies par l’annexe 2 du décret n° 2021-699 du 1er juin 2021, les professionnels mentionnés à l’article 12 de la loi du 5 août 2021 (par exemple, les personnes exerçant leur activité dans les établissements de santé mentionnés à l’article L. 6111-1 du code de la santé publique) doivent être vaccinés contre la covid-19 ; cette obligation s’applique dans les conditions précisées dans le document « Questions/Réponses » disponible sur ce site.

Les personnes concernées (sauf celles chargées de l’exécution d’une tâche ponctuelle, c’est-à-dire celles intervenant de manière non récurrente pour des tâches de très courte durée) doivent justifier, auprès de leur employeur, avoir un schéma vaccinal complet ou ne pas y être soumises en raison de contre-indication médicale ou d’un rétablissement après une contamination par la covid-19 (pour le détail, se reporter à l’article 49-1 du décret du 1er juin 2021).

Dans une décision rendue le 2 mars 2022 à propos des professionnels soumis à l’obligation vaccinale (en l’espèce, il s’agissait de personnes exerçant leur activité dans un établissement de santé), le Conseil d’État précise que cette obligation « s’impose à toute personne travaillant régulièrement au sein de locaux relevant d’un établissement de santé mentionné à l’article L. 6111-1 du code de la santé publique, quel que soit l’emplacement des locaux en question et que cette personne ait ou non des activités de soins et soit ou non en contact avec des personnes hospitalisées ou des professionnels de santé. »

Lorsque l’employeur constate qu’un salarié ne peut plus exercer son activité en raison du non-respect de l’obligation vaccinale ainsi définie, il l’informe sans délai des conséquences qu’emporte cette interdiction d’exercer sur son emploi ainsi que des moyens de régulariser sa situation. Le salarié qui fait l’objet d’une interdiction d’exercer peut utiliser, avec l’accord de son employeur, des jours de repos conventionnels ou des jours de congés payés. A défaut, son contrat de travail (CDI, CDD, etc.) est suspendu. Cette suspension s’accompagne de l’interruption du versement de la rémunération ; elle prend fin dès que le salarié remplit les conditions nécessaires à l’exercice de son activité et ne peut être assimilée à une période de travail effectif pour la détermination de la durée des congés payés ainsi que pour les droits légaux ou conventionnels acquis par le salarié au titre de son ancienneté. Pendant cette suspension, le salarié conserve le bénéfice des garanties de protection sociale complémentaire auxquelles il a souscrit (disposition d’ordre public à laquelle il ne peut être dérogé).
Lorsque le contrat à durée déterminée d’un salarié est suspendu dans les conditions précisées ci-dessus, le contrat prend fin au terme prévu si ce dernier intervient au cours de la période de suspension.

Les certificats de contre-indication médicale ou de rétablissement peuvent être présentés au médecin du travail compétent, qui informe l’employeur, sans délai, de la satisfaction à l’obligation vaccinale avec, le cas échéant, le terme de validité du certificat transmis.
Les salariés concernés par l’obligation vaccinale justifient avoir satisfait à cette obligation ou ne pas y être soumis auprès de leur employeur. Les employeurs sont chargés de contrôler le respect de cette obligation par les personnes placées sous leur responsabilité.
Lorsque, au regard de l’évolution de la situation épidémiologique ou des connaissances médicales et scientifiques, telles que constatées par la Haute Autorité de santé (HAS), l’obligation vaccinale n’est plus justifiée, celle-ci est suspendue par décret, pour tout ou partie des catégories de personnes soumises à cette obligation. La Haute Autorité de santé évalue ces éléments de sa propre initiative ou sur saisine du ministre chargé de la santé, du Comité de contrôle et de liaison covid-19 ou de la commission permanente chargée des affaires sociales de l’Assemblée nationale ou du Sénat.
Cette disposition est issue de la loi du 30 juillet 2022 citée en référence, en vigueur depuis le 1er août 2022.
Tous les salariés bénéficient d’une autorisation d’absence pour se rendre aux rendez-vous médicaux liés aux vaccinations contre la Covid-19.

Les heures effectives !

Il correspond au nombre d’heures rémunérées au taux de base (hors heures supplémentaires) convenu avec votre salariée, y compris les heures d’absence pour congés payés et les heures de présence responsable converties en heures de travail effectif.

LES TRAVAUX ET LE LAPS !

À noter : les heures de présence responsable correspondent aux heures où la garde d’enfants à domicile peut utiliser son temps pour elle-même tout en restant vigilante pour intervenir s’il y a lieu. Une heure de présence responsable équivaut à 2/3 d’une heure de travail effectif.

Si votre garde d’enfants à domicile effectue 12 heures de présence responsable par semaine, cela équivaut à 8 heures de travail effectif.

Federal Charges Announced Against Maine Man Who Carried Out Machete Attack in Times Square on New Year’s Eve in Name of Jihad !!!

Trevor Thomas Bickford Traveled to Times Square for the Purpose of Killing U.S. Officials in the Name of Radical Islamic Jihad, and Used a Machete-Style Knife to Attack Three NYPD Officers Working in Coordination with the FBI to Protect the New Year’s Eve
Trevor Thomas Bickford, 19, of Wells, Maine, has been charged with federal crimes in connection with Bickford’s efforts to wage jihad by killing U.S. Government officials and his knife attack on three NYPD officers in Times Square on New Year’s Eve. Bickford was charged by complaint with attempting to kill officers and employees of the U.S. Government and persons assisting them. Bickford is currently in state custody and will be transported to and presented in Manhattan federal court at a later date to face the federal charges filed in the Southern District of New York.

“As detailed in today’s complaint, we allege that the defendant plotted a jihad-inspired attack targeting U.S. government officials, and on December 31st, 2022, attacked three NYPD officers who were part of the joint federal-state law enforcement operation protecting the Times Square New Year’s Eve celebration,” said Attorney General Merrick B. Garland. “We are deeply grateful for the bravery of the officers who were injured in this horrible attack and who put their lives on the line every day to serve their communities. Together with our law enforcement partners at every level of government, the Justice Department will continue to work to disrupt, investigate, and prosecute those who target and attack law enforcement and endanger the American people.”

“On this past New Year’s Eve, revelers flocked to Times Square to ring in the New Year with friends and family.  But Trevor Bickford allegedly targeted the iconic yearly celebration to carry out a brazen act of violence and hatred in the name of jihad,” said U.S. Attorney Damian Williams for the Southern District of New York. “Bickford’s alleged attack in one of the most visited destinations in the world on its busiest night of the year ironically only served to spotlight the coordination, resolve and dedication of American law enforcement to guard the wellbeing of the public. We sincerely thank our law enforcement partners for their outstanding work and bravery, and especially wish a full and speedy recovery to the officers injured in this senseless attack.”

“As alleged, three New York City Police Department officers were brutally assaulted in a jihad-inspired attack on New Year’s Eve while they were performing their duties to protect their city and those out celebrating the holiday,” said FBI Director Christopher Wray. “Being a law enforcement officer requires brave individuals willing to put their lives on the line every day to keep others safe. We are committed to holding those who would target law enforcement with violence fully accountable.”

“As we allege today, Bickford deliberately planned and executed his violent attack against New York City Police Officers who were simply doing their job protecting the public,” said Assistant Director Michael J. Driscoll of the FBI New York Field Office. “Only the quick action of these brave officers prevented further harm. The FBI's New York Joint Terrorism Task Force is unwavering in its mission to combat terrorism to keep our city safe, and we will bring any radicalized individual willing to commit violence to justice.”

“An attack against New York City police officers is an attack against all of us – and today’s charges make it clear that such violence will be prosecuted to the fullest extent of the law,” said NYPD Commissioner Keechang L. Sewell. “Our NYPD family is thankful our heroic officers survived this premeditated ambush, and the entire city commends them for preventing further bloodshed during one of our nation’s largest public events.  Clearly, the threat of jihadist terrorism remains very real, and our country’s security begins with the dedicated local, state, and federal law enforcement officers who are committed to keeping us safe.  I applaud our NYPD investigators, our partners on the FBI’s New York Joint Terrorism Task Force, and the prosecutors in the U.S. Attorney’s Office for the Southern District of New York for their combined efforts on this important case.”

According to the allegations contained in the complaint charging the defendant:

In the summer of 2022, Bickford, a 19-year-old U.S. citizen and resident of Maine, began accessing and consuming materials espousing radical Islamic ideology, including materials promoting the Taliban and reflecting the teachings of Abu Muhammad al-Maqdisi, a prominent radical Islamic cleric who was a spiritual mentor of al Qaeda. Over the ensuing months, Bickford radicalized, devoting himself to violent Islamic extremism and waging jihad.

By November 2022, Bickford was interested in traveling to the Middle East to support the Taliban and took steps towards traveling to Afghanistan to ally himself with the Taliban and work with the Taliban to fight against governments that, in Bickford’s view, oppress Muslims. Bickford dedicated himself to the mission of waging jihad against officials of governments that he believes are anti-Muslim, including the U.S. Government. Bickford told a family member that he wanted to travel to the Middle East so that he could be a suicide bomber for his religion. Bickford ultimately decided that he would not travel overseas, and instead would wage jihad against the U.S. Government within the United States.

To carry out his jihadist mission, Bickford traveled from Maine to New York City in late December. On New Year’s Eve, Bickford went to Times Square for the purpose of killing U.S. Government officials, armed with a large, curved knife similar to a machete, known as a kukri, with a blade over one foot long.

Protecting the civilians who attend the annual New Year’s Eve celebration in Times Square requires and involves the coordination, collaboration, and mutual assistance of multiple federal and state law enforcement agencies, including the FBI and NYPD. During this special event, the FBI and NYPD work together and assist each other in the performance of their respective duties, in a collective effort to ensure a safe Times Square New Year’s Eve celebration.

At approximately 10:10 p.m., at 52nd Street and Eighth Avenue, blocks away from the New Year’s Eve celebration in Times Square, Bickford attacked three NYPD officers, who were detailed to the joint federal-state law enforcement operation to protect the New Year’s Eve celebration. The location of 52nd Street and Eighth Avenue was an access checkpoint at which spectators could gain entry to the events in Times Square, and both FBI and NYPD personnel were deployed in the area of the checkpoint, including the three officers whom Bickford attacked. Bickford approached the NYPD officers, declared “Allahu Akbar”—an Arabic phrase meaning “God is great,” which other radical Islamic extremists have similarly proclaimed while carrying out terrorist attacks—and stabbed and struck the officers in the head with his kukri. Before Bickford could attack more targets, one of the victim officers shot Bickford in the shoulder, stopping the attack, and he was taken into state custody. Bickford wounded all three officers, who suffered lacerations and other injuries, and each officer had to be taken to a hospital for treatment.

A bag that Bickford brought with him to the Times Square area was subsequently recovered by law enforcement from the scene of the attack. Bickford’s bag contained, among other things, a book by al-Maqdisi promoting jihad and Bickford’s journal. The al-Maqdisi book encourages followers, among other things, to wage jihad against disbelievers and governments ruled by disbelievers, and to use swords on the heads of disbelievers. An entry in Bickford’s journal from December 31, 2022—that is, the day of his attack—states that “this will likely be my last entry” and that Bickford believed his brother, a soldier in the U.S. military, had “joined the ranks of my enemy.” A second bag that Bickford was carrying, also recovered by law enforcement near Times Square, contained a book espousing violent Islamic extremism, with certain portions highlighted, including the following: “Fight in the Name of Allah and in the Cause of Allah. Fight against those who do not believe in Allah. Wage a holy war.”

After being treated at a local hospital, during a subsequent Mirandized interview, Bickford stated, among other things, the following:

Bickford decided not to travel overseas to wage jihad as originally planned, and instead to commit jihad in New York City. In the days leading up to his New Year’s Eve attack, Bickford traveled from Maine to New York City.
On New Year’s Eve, Bickford went to Times Square, and walked around the area “trying to figure out the right time to kill.” Bickford started reciting verses from the Quran in his head to “hype himself up” for his attack. Bickford identified an NYPD officer who was isolated from civilians and other officers, took out the kukri from his backpack, declared “Allahu Akbar,” and attacked the officer.
After attacking that officer, Bickford charged at another officer, and tried but failed to remove that officer’s firearm from the officer’s holster. One of the officer victims then shot Bickford in the shoulder, stopping his attack.
When asked why he conducted the attack, Bickford stated that the officer was a man in uniform who had a weapon; all men of military age were his targets; no one can work for the U.S. Government and be a true Muslim, because the U.S. Government supports Israel; and he wanted to kill as many of these targets as he could.
Bickford intended to die in the attack, in an effort to achieve martyrdom. Bickford believed his attack was unsuccessful, because he did not kill any officers, and he did not die himself.
Bickford is charged with four counts of attempted murder of officers and employees of the U.S. Government and persons assisting them, each of which carries a maximum sentence of 20 years in prison. The charges carry an aggregate potential sentence of 80 years in prison.

The FBI’s New York Joint Terrorism Task Force, which consists of investigators and analysts from the FBI, the NYPD, and over 50 other federal, state, and local agencies is investigating the case.

Assistant U.S. Attorneys Sarah L. Kushner and Kaylan E. Lasky for the Southern District of New York are prosecuting the case, with assistance from Trial Attorney D. Andrew Sigler of the National Security Division’s Counterterrorism Section.

A complaint is merely an allegation. All defendants are presumed innocent until proven guilty beyond a reasonable doubt in a court of law.

The Senior Resident Legal Advisor (SRLA) will represent the U.S. Department of Justice through OPDAT’s field office in Mexico City, Mexico, where they will focus on implementing foreign criminal justice sector institutional development and technical assistance programs. The SRLA will work closely with local law enforcement and government officials, including prosecutors, judges, investigators, parliamentarians, and others, to develop, implement, and strengthen OPDAT capacity building programs. The SRLA will also work closely with OPDAT headquarters staff and officials of the Department of State, U.S. Agency for International Development, operational law enforcement agencies, and in-country U.S. and foreign authorities to ensure the assistance program meets the needs of the host nation while supporting Departmental and U.S. policy objectives.

The SRLA will be responsible for the implementation of programs that focus on criminal justice sector institutional development in the host nation, specifically with the judiciary capacity building. However, these programs may also include aspects of transition and implementation of the accusatorial system, assessment of the legal system, prosecutorial capacity building, investigation and prosecution of complex transnational cases, trial advocacy skills development, money laundering and asset forfeiture, trafficking in persons, evidence collection and preservation, as well as pretrial alternatives.

For the purposes of the U.S. Embassy and OPDAT HQ, the SRLA will act as the head of OPDAT’s field office in Mexico City, Mexico.

Cette série raconte l'histoire de la compagnie Bravo, un peloton de jeunes soldats américains, pendant la guerre du Viêt Nam à la fin des années 1960.
Tandis que les États-Unis sont agités par des mouvements pacifistes, ces jeunes hommes se retrouvent dans un milieu hostile où ils doivent faire face aussi bien aux troupes ennemies qu'à leurs propres angoisses.
L'Enfer du devoir ne montre pas que les aspects atroces de la guerre mais dépeint aussi les problèmes humains que rencontrent, au quotidien, ces jeunes soldats.
